1. About these terms

These Terms of Service ("Terms") govern your access to and use of the website at magnova.com.au (the "Site") and your purchase of any products from us.

The Site is operated by Magnova Pty Ltd (ACN 693 400 154, ABN 70 693 400 154), trading as Magnova ("Magnova", "we", "us", "our").

By accessing the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

We recommend you save or print a copy of these Terms for your records.

2. Who can buy from us

To place an order you must be at least 18 years old and legally capable of entering into a binding contract. If you are under 18, you may only use the Site with the involvement of a parent or guardian.

By placing an order you confirm that all information you provide is accurate and complete, and that you are using an authorised payment method.

3. Products and specifications

We take care to describe our products accurately, including dimensions, materials, component clearances, and compatibility information.

Product specifications are provided to help you assess compatibility with your chosen components. You are responsible for confirming that the components you intend to use fit within the stated clearances. Where we recommend specific third-party components, those recommendations are illustrative only — we do not supply, endorse, or warrant third-party products, and compatibility can change as manufacturers revise their designs.

Product images are indicative. Colours may vary depending on your display, and finishes may vary slightly between production batches.

We may improve or revise our products between production batches. Where a revision materially changes a specification that a reasonable customer would rely on, we will publish the change and, for undelivered pre-orders, notify affected customers and offer the option to cancel for a full refund (see clause 6).

4. Prices, currency and taxes

All prices are shown in the currency selected in your region selector. Prices for Australian customers are in Australian dollars and include GST where applicable.

Where our checkout indicates that duties and taxes are included, the price you pay at checkout covers applicable import duties and taxes for your destination. Where it does not, you are responsible for any customs duties, import taxes, brokerage, or handling fees levied by your destination country. We cannot predict these amounts.

Prices may change at any time before you place an order. A change in price does not affect an order we have already accepted.

We try to ensure pricing is accurate. If a product is listed at an obviously incorrect price due to a technical or typographical error, we may cancel the order and provide a full refund rather than supply at that price. We will contact you before doing so.

5. Orders

When you place an order, you make an offer to buy the product on these Terms.

The order confirmation email you receive automatically is an acknowledgement that we have received your order. It is not acceptance of your order. A contract is formed only when we send you a dispatch confirmation, or — for pre-orders — when we send you written confirmation that your order has been accepted into a production batch.

We may decline or cancel an order before acceptance, including where the product is unavailable, where we identify a pricing or description error, where we cannot verify your payment or delivery details, or where we reasonably suspect fraudulent or fraudulent-adjacent activity. If we decline an order after payment has been taken, we will refund you in full.

6. Pre-orders and estimated shipping dates

Some products are sold on a pre-order basis and are allocated to a production batch. Where this applies, it is stated clearly on the product page along with an estimated shipping window.

By placing a pre-order you acknowledge and agree that:

(a) Payment is taken at the time of order. Your payment reserves a unit in the nominated batch.

(b) Shipping dates are estimates, not guarantees. Estimated dates are based on our current manufacturing and logistics schedule. Manufacturing, tooling, freight, and customs timelines can move for reasons outside our control.

(c) We will keep you informed. We will notify you by email of any material change to your batch's estimated shipping window as soon as we become aware of it.

(d) You may cancel for a full refund at any time before your order is dispatched. To cancel, email us at magnova@outlook.com.au from the address used to place the order. We will refund the full amount you paid to the original payment method, without deduction and without requiring a reason.

(e) Extended delays. If your order has not been dispatched within 60 days of the latest estimated shipping date we have notified to you, you may cancel and receive a full refund, and we will also remind you of that right at that time.

Nothing in this clause limits your rights under the Australian Consumer Law, including your right to a remedy where goods are not supplied within a reasonable time.

7. Payment

We accept the payment methods displayed at checkout. Payments are processed by third-party payment providers, and their terms apply to the payment transaction. We do not store your full card details.

You must have authority to use the payment method you provide.

8. Shipping, delivery, risk and title

We ship to the destinations available in our checkout. Shipping costs and estimated transit times are shown before you complete your order.

Delivery timeframes are estimates. We are not responsible for delays caused by carriers, customs authorities, weather, or other events beyond our reasonable control, but we will help you trace and resolve a delayed shipment.

Risk in the goods passes to you on delivery to the address you provide. Title passes to you when we have received payment in full.

You are responsible for providing an accurate and complete delivery address. Where a parcel is returned to us as undeliverable because of an incorrect address, or is unclaimed, we will contact you to arrange redelivery at your cost, or refund the price of the goods less our original outbound shipping cost.

For international orders, you may be the importer of record and responsible for compliance with your country's import requirements.

9. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot be excluded, restricted, or modified by agreement. Where any part of these Terms would have that effect, it does not apply to the extent of the inconsistency.

If you are located outside Australia, you may also have rights under the consumer protection laws of your own country. These Terms do not limit those rights.

10. Warranty against defects

In addition to your rights under the Australian Consumer Law, we provide a voluntary warranty against defects on the following basis.

What is covered: We warrant that our products will be free from defects in materials and workmanship under normal use for 12 months from the date of delivery.

What we will do: If a valid warranty claim is made, we will, at our option, repair the product, replace the product or the defective part, or refund the purchase price. We will bear the reasonable cost of returning the product to us for a valid claim.

What you must do: Contact us at magnova@outlook.com.au with your order number, a description of the fault, and photographs or video showing the issue. Do not return a product before contacting us.

What is not covered: Damage caused by misuse, accident, modification, unauthorised repair, normal cosmetic wear, or use outside the product's stated specifications; damage to third-party components installed in the product; and damage arising from installation that does not follow our instructions.

The benefits given by this warranty are in addition to other rights and remedies you have under a law in relation to the goods to which this warranty relates.

11. Returns and change of mind

Our full returns process is set out in our Refund Policy, which forms part of these Terms.

Change of mind: We accept change-of-mind returns within 30 days of delivery, provided the product is unused, undamaged, and returned in its original packaging with all included accessories. Return shipping for change-of-mind returns is at your cost, and we may deduct our original outbound shipping cost from the refund. Change-of-mind returns are offered in addition to, and do not affect, your rights under clause 9.

Faulty or incorrect goods: If your product arrives damaged, faulty, or is not what you ordered, contact us within a reasonable time and we will arrange a remedy at our cost.

Pre-order cancellations are dealt with under clause 6(d).

12. Intellectual property

All content on the Site — including the Magnova name and logo, product designs, photographs, illustrations, text, and the layout of the Site — is owned by us or our licensors and is protected by intellectual property laws.

You may view, download, and print content from the Site for your own personal, non-commercial use. You must not otherwise reproduce, distribute, modify, or create derivative works from our content, or use our trade marks, without our prior written permission.

You may share product photographs for the purpose of reviewing or discussing our products, provided you attribute them to Magnova.

If you send us feedback, suggestions, or ideas about our products, you grant us a perpetual, royalty-free licence to use them without obligation to you. We will not treat unsolicited feedback as confidential.

13. User content

If you submit a review, comment, image, or other material to the Site or our social channels, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that material in connection with our business, including in marketing.

You must not submit material that is unlawful, misleading, defamatory, infringing, or that you do not have the right to share. We may remove user content at our discretion.

14. Acceptable use

You must not:

  • use the Site for any unlawful purpose or in breach of these Terms;
  • attempt to gain unauthorised access to the Site, our systems, or another user's account;
  • interfere with the operation of the Site, including by introducing malicious code or placing unreasonable load on our infrastructure;
  • scrape, harvest, or systematically extract data from the Site other than as permitted by our published robots.txt and agents.md; or
  • resell our products commercially without our prior written agreement.

15. Third-party links and services

The Site may link to third-party websites, applications, and services that we do not control. We provide those links for convenience only. We are not responsible for the content, products, or practices of third parties, and their inclusion does not imply endorsement.

Where our checkout, payment, shipping, or analytics functions are provided by third parties, those services are subject to the providers' own terms and privacy policies.

16. Availability of the Site

We aim to keep the Site available but we do not guarantee uninterrupted access. We may suspend, withdraw, or restrict all or part of the Site for maintenance, upgrades, or operational reasons. Where practical, we will give notice.

17. Limitation of liability

Nothing in this clause limits our liability where it cannot be limited by law, including under clause 9.

Subject to that, and to the extent permitted by law:

(a) Where a consumer guarantee applies to goods we supply and the failure is not a major failure, our liability is limited, at our option, to repairing or replacing the goods, supplying equivalent goods, or paying the cost of doing so.

(b) We are not liable for loss or damage that was not reasonably foreseeable at the time the contract was formed.

(c) We are not liable for damage to third-party components that you install in or with our products, except to the extent that damage was caused by a defect in our product or our negligence.

(d) We are not liable for business losses. If you use our products for a commercial purpose, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.

18. Indemnity

You agree to indemnify us against loss or damage we suffer arising from your breach of these Terms or your unlawful use of the Site, except to the extent that loss or damage is caused by our own negligence or breach.

19. Privacy

We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.

20. Changes to these Terms

We may update these Terms from time to time to reflect changes to our products, our business, or the law. The version published on the Site at the time you place an order is the version that applies to that order. Changes will not apply retrospectively to orders we have already accepted.

We will update the "Last updated" date at the top of this page whenever we make a change. For material changes affecting undelivered pre-orders, we will notify affected customers by email.

21. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.

If you are a consumer resident in another country, this clause does not deprive you of the protection of the mandatory consumer laws of your country of residence.

Before starting formal proceedings, please contact us at magnova@outlook.com.au so we can try to resolve the matter directly. Most issues can be sorted out quickly. If we cannot resolve a dispute, you may be able to contact the consumer protection agency in your state or territory, or the Australian Competition and Consumer Commission.

22. General

Severability. If any provision of these Terms is found to be unenforceable, that provision is severed and the remaining provisions continue in force.

No waiver. If we do not enforce a right under these Terms, that does not waive our ability to enforce it later.

Assignment. You may not transfer your rights under these Terms without our consent. We may assign these Terms as part of a sale or restructure of our business, provided your rights are not adversely affected.

Entire agreement. These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, form the entire agreement between you and us in relation to your use of the Site and your purchases.

Force majeure. We are not liable for failure to perform our obligations where that failure is caused by an event beyond our reasonable control, provided we notify you and, where the delay is substantial, offer you the option to cancel for a full refund.
